Game Situation: Batted Ball Strikes Pitching Rubber


 
With one out and a runner on third base (R3), the batter hits a ground ball that strikes the pitching rubber and ricochets into foul territory between third base and home plate. The third baseman fields the ball, checks the runner at third base, throws to first base, but the throw is wild and goes out of play. R3 scored on the play and the batter ended up at 2nd base. What is the umpire's call on this play?
 
Call
"Prior to touching or passing 1st/3rd base, a batted ball is determined to be fair/foul depending on where it is first touched or settles".
 
The ground ball described below did not pass 1st/3rd base and it was first touched in foul territory -- therefore it is a foul ball. The batter returns to the plate and R3 returns to 3rd base.  
 
The MLB/OBR rule book mentions this directly:
 
Rule 2.00 (Foul Ball) Comment: A batted ball not touched by a fielder, which hits the
pitcher’s rubber and rebounds into foul territory, between home and first, or between
home and third base is a foul ball.
